What is this lawsuit about?
Beginning in 2019, a class action lawsuit was filed against Woodstream Corporation (“Defendant” or “Woodstream”). The lawsuit was brought by individuals (“Plaintiffs”) on behalf of consumers who bought a Victor-brand PestChaser in the state of New York. The lawsuit alleges that Woodstream’s PestChaser does not work as advertised.
The Defendant denies all allegations of wrongdoing and has asserted defenses against the Plaintiffs’ claims. No court has decided whether the Plaintiffs or Defendant is right, and it is Plaintiffs’ burden to prove their claims at trial.

Do I have a lawyer in this lawsuit?
In a class action, the court appoints lawyers, also called Class Counsel, to work on the lawsuit and represent the interests of all the class members. For purposes of the lawsuit, the Court has appointed the following lawyers.
Your lawyers: Timothy G. Blood and James M. Davis of Blood Hurst & O’Reardon and Yitzchak Kopel and Stephen Beck of Bursor & Fisher P.A. These are the lawyers who are bringing the lawsuit on your behalf.
You will not be charged for their services. If Class Counsel gets money or benefits for the class, they may ask the Court for an award of attorneys’ fees and expenses. If the Court grants Class Counsel’s request, the attorneys’ fees and expenses will either be deducted from any money obtained for the class or paid separately by the Defendant.
You do not need to hire your own lawyer, but if you want your own lawyer, you may hire one at your own expense.

What happens if I do nothing?
You do not have to do anything now if you want to keep the possibility of getting money or benefits from this lawsuit in the future.
If you do nothing, you will stay in the lawsuit, and if Plaintiffs obtain money or benefits in the future, you will be notified about how to get your share. If you do nothing now, you will not be able to start, continue, or be part of any other lawsuit against Defendant about the legal issues in this lawsuit. You will be legally bound by all orders and judgments.
If the Plaintiffs win or settle, class members may be entitled to money or benefits. If Defendant wins, class members will receive nothing.

Why would I want to opt out?
If you do not want to be part of the Class because you want to sue the Defendant on your own or because you disagree with the lawsuit , or you already have your own lawsuit against Defendant regarding the same legal claims in this lawsuit and you want to continue with it, or any other reason you need to opt out of the Class.
If you start your own lawsuit or continue with an existing lawsuit against Defendant regarding the same legal claims in this lawsuit after you exclude yourself, you will have to hire your own lawyer(s) for that lawsuit if you want counsel, and you will have to prove your legal claims.

What happens if I opt out?
If you opt out from the class, you won’t get any money or benefits if they become available in the future. You will not be bound by any judgments the Court makes in this lawsuit. By opting out, you will keep your right to sue the Defendant about the legal claims in this lawsuit at your own expense.

How do I opt out?
To opt out of the lawsuit (sometimes called “excluding” yourself), you must send a written “Request for Exclusion” by mail. Your request must include the following:
- Your full name, address, telephone number, and email (if any);
- Why do you believe you are a class member;
- Your personal physical signature; and
- A clear statement that you want to be excluded from the class in Maroney v. Woodstream, Case No. 7:19-cv-08294.

How and when will the Court decide who is right?
Over the coming months, Plaintiffs and/or Defendant may ask the Court to decide the claims or defenses in this case as a matter of law before proceeding to trial.
If the parties’ dispute is not resolved as a matter of law, Class Counsel will have to prove Plaintiffs’ legal claims at a trial. The trial has not been scheduled. During the trial, a Jury and the Judge will hear all of the evidence to help them reach a decision about whether Plaintiffs or Defendant are right about the legal claims in the lawsuit. There is no guarantee that the Plaintiffs will win, or that they will get any money for the class.

Do I have to attend the trial?
No. You do not need to attend the trial. Class Counsel will present the case for the Plaintiffs and the class, and lawyers for Defendant will present on their behalf. You or your own lawyer may attend at your own expense.
